Frequently Asked Questions

Answers to all things around the trademark application process.

Registration Process

The registration process is simple and consists of three steps: trademark search and verification, filing, and successful registration.

You can start by submitting the name/logo for a free trademark search report. We will prepare a feasibility report within 1 business day. If your trademark is unique or coined, we will continue to the steps of the process.

In the next step, we will be confirming the owner of the trademark & billing details, selecting classes of goods & services in which you would like to protect the name and completing the filing for your approval.

Once approved, we will file it on your behalf, all that is left is to wait for the successful registration.

Firstly, our team will provide you with a trademark feasibility report within 1 business day to evaluate the distinctiveness of your trademark.

Once the filing details are confirmed, we will file for it within 1 business day.

Our team of consultants will evaluate the distinctiveness of the trademark. We evaluate not only the uniqueness of the mark but check also for identical trademarks filed in similar classes as well as trademarks that have been registered in other classes. If the mark is not unique enough for a given category, it could be dismissed by the trademark office. If the mark meets this criterion, we check whether an identical trademark is being registered.

If we identify any such cases, we list them in the feasibility report and the overall risk assessment.

If you are a citizen of the jurisdiction/country you are applying for, you can file a trademark. Otherwise, you will need a representative.

Trademark consultants have much higher success rates due to experience and familiarity with the process flow.

Trademark Knowledge

Trademarks are intended to protect the uniqueness of distinctive brands such as your logos, product name, or slogan.

Copyright ensures the protection for the creators of original, mainly artistic, works such as literary creations, musical, dramatic, and artistic creations by way of websites, photographs, etc.

A patent is intended to protect the technical aspects of a new invention, preventing others from imitating it such as new and highly innovative products/services.

All trademarks are valid for 10 years regardless of jurisdiction and need to be renewed only then.

Trademark NICE classification refers to an international classification of goods and services applied for the registration of marks. There are 45 classes each intended for different products and services.

Registering in more classes gives you broader protection against all potential business scope expansion. At the same time, your application will become more expensive (due to additional government and service fees).

We strongly recommend that you select the NICE classifications that cover the core business in the present and foreseeable future.

As your business expands and grows, you can expand the classification as you go and this can be the same as for the country expansion too.

Colour are not necessarily treated as a differentiating element, we recommend registering a B&W version as it also covers any colour variant.

Trademarks protects not only against poaching of your branding but prevents competitors for using identical marks that may confuse the general consumer.

If you register your business or product name (wordmark), it protects the name in any visual context but not the visual content, so another company could use a similar stylized mascot or logo with a different name.

If you register a logo, which features the business or product name as a dominant element, you get protection on the words as well. It means you can object if somebody tries to register a similar name and claim infringement of your mark if a competition operates under the same or similar name or stylized logo.

In general, the best value for money and efficient way to register a trademark, is to do so on the version which will be used most often. If you want a broader protection, you may need two trademarks.
